For Cancerguard® Gift Cards

Introduction

These Terms and Conditions (“Purchase Terms” or “Terms”) govern the purchase and use of gift cards (the “Gift Card(s)”), issued solely by Exact Sciences Corporation (“Exact Sciences” or “we” or “us”) exclusively for the purchase of the Cancerguard test. "You", "you," "your," and "yourself," refers to you as an individual purchaser of the Gift Card(s), plus any entity, individual, and/or organization on whose behalf you are purchasing the Gift Card(s). By purchasing the Gift Card(s) you agree to these Terms. Please read them carefully before making your purchase.

  1. Purchase and Activation

    • Gift Cards for the Cancerguard test are available for purchase exclusively through our official website, https://shop.cancerguard.com.
    • Upon successful payment, the Gift Card will be delivered directly to the email address provided at the time of purchase, which may be your email, or the email of your intended recipient of the Gift Card.
    • If sending the Gift Card directly to the recipient, please ensure the accuracy of the recipient’s email address. Exact Sciences is not responsible for Gift Cards delivered to incorrect or invalid email addresses provided by the purchaser.
    • When providing any personal information for a recipient, you understand Exact Sciences may collect, store, retain, transmit, and use all recipient personal information provided by you pursuant to the terms and conditions in our Privacy Policy https://www.exactsciences.com/privacy-policy, as applicable.
    • Cancerguard cannot be obtained without a prescription. You, as the purchaser, acknowledge and agree that you, or your intended recipient, may not be eligible for Cancerguard. Please refer to our FAQ page for more information on eligibility. For more information on what happens to the Gift Card if you or a Gift Card recipient are denied a prescription required to purchase Cancerguard see the section below, “Redemption.”

  2. Redemption

    • Gift Cards may be redeemed exclusively on our website and solely for the purchase of the Cancerguard test.
    • The Cancerguard test cannot be purchased without a prescription and, therefore, the purchased Gift Card shall only be redeemed when you or the recipient successfully completes the Cancerguard ordering process and provides payment using the Gift Card.
    • Gift Cards cannot be exchanged for cash, or refunded, even if the recipient does not use the Gift Card or is ineligible for the Cancerguard test. Unused Gift Cards may, however, be transferred to another individual for their purchase of a Cancerguard test, subject to the same eligibility requirements referred to herein.
    • Exact Sciences expressly disclaims any and all liability arising from the purchase, delivery, or attempted redemption of Gift Cards by you or recipients who do not meet such eligibility requirements, or choose not to redeem the Gift Card, and no refunds or replacements will be provided in such circumstances.
    • Resale of Gift Cards to third parties for cash or other consideration is prohibited.
    • No maintenance or service fees apply to Gift Cards.

  3. Expiration

    • Gift Cards do not have an expiration date and will remain valid until fully redeemed for a Cancerguard test, regardless of any future changes to the price. We reserve the right to modify this policy at any time, subject to applicable law and with reasonable advance notice to You, the purchaser.

  4. Lost or Stolen Gift Cards

    • Keep your Gift Card information secure. Lost or stolen Gift Cards cannot be replaced or refunded.
    • We are not responsible for unauthorized use of Gift Cards.

  5. Limitations

    • Gift Cards are valid only for purchases made on our official website and for the purchase of a Cancerguard test.
    • You may not purchase more than ten (10) Gift Cards at one time.
    • We reserve the right to refuse, cancel, or hold for review Gift Cards or orders suspected of fraud, unauthorized use, or violation of these Terms.

  6. Changes to Terms and Conditions

    • We reserve the right to change these Terms at any time. The most current version will be posted here. Continued use of the Gift Card constitutes acceptance of any changes.

  7. Governing Law

    • These Terms are governed by the laws of the state of Wisconsin, without regard to conflict of law principles.
    • You may not purchase more than ten (10) Gift Cards at one time.
    • We reserve the right to refuse, cancel, or hold for review Gift Cards or orders suspected of fraud, unauthorized use, or violation of these Terms.

Acceptance of Terms

By purchasing or using a Gift Card, you acknowledge that you have read, understood, and agreed to these Purchase Terms.
